சென்னை பள்ளிக்கரணையில் பேனர் விழுந்து சுபஸ்ரீ என்ற இளம்பெண் நேற்று உயிரிழந்தார். இதையடுத்து தாமாக முன்வந்து வழக்கை விசாரணைக்கு எடுத்து கொண்ட சென்னை உயர்நீதிமன்ற நீதிபதிகள், பேனர்கள் வைப்பது தொடர்பாக நீதிமன்றம் பிறப்பிக்கும் உத்தரவுகளை அதிகாரிகள் உரிய முறையில் பின்பற்றுவதில்லை, மெத்தனமாக செயல்படுவதாக கண்டனம் தெரிவித்தனர்.ஆளும் கட்சியினர் நீதிமன்ற உத்தரவை பின்பற்றாமல் சட்ட விரோத பேனர்கள் வைப்பதாக கூறிய நீதிபதிகள், மக்களின் ரத்தத்தை உறிபவர்கள் போல அரசு அதிகாரிகள் உள்ளனர் என்றும் கண்டித்தனர். எந்த கட்சி ஆட்சிக்கு வந்தாலும் இதே நிலைதான் என்றும், அதிகாரிகள் ஆளுங் கட்சியின் முகவர்களாக மாறுகின்றனர் என்றும் தெரிவித்தனர். விபத்து ஏற்படும் போது பாதிக்கப்பட்ட குடும்பத்திற்கு இழப்பீடு மட்டும் அளித்து அதிகாரிகள் பிரச்சினையை முடித்துக் கொள்கிறார்கள் எனவும் நீதிபதிகள் குறிப்பிட்டனர்.
சட்டவிரோத பேனர்களை அதிகாரிகள் எப்படி அனுமதிக்கிறார்கள் எனவும் நீதிமன்ற உத்தரவுகளை அதிகாரிகளால் ஏன் அமல்படுத்த முடியவில்லை எனவும் அரசு தலைமை வழக்கறிஞரிடம் நீதிபதிகள் சரமாரியாக கேள்வி எழுப்பினர். சட்டவிரோத பேனர்களுக்கு அரசியல் கட்சியினரே பெருமளவு காரணம் என்று குறிப்பிட்ட நீதிபதிகள், கிடா வெட்டு, காது குத்து போன்ற சொந்த நிகழ்ச்சிகளுக்குகூட பேனர் வைத்தால்தான் அமைச்சர்கள் விழாவுக்கு வருவார்களா என தமிழிலேயே கேள்வி எழுப்பினர். பேனர்கள் வைக்காவிட்டால், அமைச்சர்களுக்கு வழிதெரியாமல் போய்விடுமா, இல்லை அமைச்சர்கள் தொலைந்து போய்விடுவார்களா என்றும் நீதிபதிகள் வினவினர்.
பொது சாலையை ஆக்கிரமித்தும் போக்குவரத்துக்கு இடையூறாகவும் பேனர்கள் வைக்கப்படும்போது கூட ஏன் நடவடிக்கை எடுப்பதில்லை என கேள்வி எழுப்பினர். சட்ட விரோத பேனர்கள் விவகாரத்தில் எத்தனை உத்தரவுகள் போட்டாலும் அரசு செயல்படுத்துவதில்லை எனவும் அரசின் மீதான நம்பிக்கையை நீதிமன்றம் இழந்துவிட்டதாகவும் நீதிபதிகள் குறிப்பிட்டனர். இன்னும் எத்தனை உயிர் பலிகளை அரசும், அதிகாரிகளும் எதிர்பார்க்கிறீர்கள், இன்னும் எவ்வளவு ரத்தத்தை உறிஞ்ச நினைக்கிறீர்கள் என நீதிபதிகள் காட்டமாக கேட்டனர். மேலும், உயிர்ப் பலி ஏற்படும்போது இழப்பீடு, கருணைத் தொகை தந்துவிட்டால் போதுமா, அது போன உயிரை மீட்டுத் தருமா என்றும் நீதிபதிகள் கேள்வி எழுப்பினர்.
